    The court

The court decides how property is divided if you can’t agree, using the “just and proper” standard in ORS 107.105, and it can make temporary orders about the house while the case is pending under ORS 107.095.

What the local rules say about mediation

Linn County SLR 12.005 requires mediation of custody, parenting time and visitation disputes unless the court finds good cause, which can include domestic abuse or a power imbalance. Under SLR 13.005 the court may require arbitration when property and debt are the only issues left.

So in Linn County, decisions about the house usually come from your own written agreement, worked out with your attorneys, or from the judge. The clearer that agreement is about the sale, the less there is to fight about later. Read the rules themselves: Linn County Supplementary Local Rules 2026.

    When the house sells

Escrow records the deed for you at closing. The property tax account is worth looking up early, so you both see the same tax figures before you agree who pays what until the sale closes.
