    The court

The court decides how property is divided if you can’t agree, using the “just and proper” standard in ORS 107.105, and it can make temporary orders about the house while the case is pending under ORS 107.095. Lane County SLR 8.042 sets out how to ask the court for exclusive use of the family home while a case is pending: an affidavit, an order to show cause, and service at least 21 days before the hearing.

What the local rules say about mediation

Lane County SLR 8.012 requires mediation when custody or parenting time is in dispute, and parent education is required under SLR 8.011. The local rules have no mediation program for property or money. Parties can agree to use an independent mediator.

So in Lane County, decisions about the house usually come from your own written agreement, worked out with your attorneys, or from the judge. The clearer that agreement is about the sale, the less there is to fight about later. Read the rules themselves: Lane County Supplementary Local Rules 2026.

    When the house sells

Escrow records the deed for you at closing. The property tax account is worth looking up early, so you both see the same tax figures before you agree who pays what until the sale closes.
